Welcome to School Parents
THE EDUCATION COMMUNITY FOR PARENTS
School Parents brings together a diverse community to discuss homeschooling in a free exchange of ideas and success stories. These Terms govern your use of School Parents and the other products, services, technologies, and software we offer (the School Parents Products or Products), except where we expressly state that separate terms (and not these) apply. These Products are provided to you by Cyber Valley Agency LLC.
We don’t charge you to use School Parents or the other products and services covered by these Terms. Instead, businesses and organizations pay us to show you ads for products and services. By using our Products, you agree that we can show you ads that we think will be relevant to you and your interests. We use your personal data to help determine which ads to show you.
We don’t sell your personal data to advertisers, and we don’t share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you give us specific permission. Instead, advertisers can tell us things like the kind of audience they want to see their ads, and we show those ads to people who may be interested. We provide advertisers with reports about the performance of their ads that help them understand how people are interacting with their content.
Our Privacy Policy (below) explains how we collect and use your personal data to determine some of the ads you see and provide all of the other services described below.
Our Obligations
School Parents is provided on a best efforts basis. We do our best to keep School Parents safe, but we cannot guarantee it. If at any time you feel your rights as a user have not been upheld or you have any questions, please contact us.
You are encouraged to immediately report objectionable material or inappropriate behavior to a Site Administrator.
Your Obligations
Discussion on School Parents is limited to the subject of homeschooling in a respectful manner so as to not offend others. You may not use our Products to do or share anything:
- Offensive or inappropriate in nature, including but not limited to unauthorized commercial communications (such as spam), intimidation, harassment, or adult content.
- Unlawful, misleading, discriminatory or fraudulent.
- That infringes or violates someone else's rights, including their intellectual property rights.
- That may enables viruses, malicious code, unauthorized data collection, or attempts to access data that you do not have permission to access.
We may disallow or remove any content that we think is outside of our policies.
You must provide accurate information about yourself, create only one account, and not share your password. You may not use our Products if you are: under 13 years old, a convicted sex offender, or previously prohibited from receiving our Products for violations of our policy or under applicable laws. We reserve the right to suspend or remove your account at any time.
Any content or files you upload to School Parents are subject to copyright law. You are responsible to ensure that you have permission to reproduce and publish any work that is not your own. When you post or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, and create derivative works of your content. We reserve the right to keep copies of this content even if you request deletion. You also give us permission to use your profile picture and information about actions you have taken in connection with ads, offers, and other sponsored content that we display across our Products, without any compensation to you.
Any unsolicited contact you receive as a result of personal information you have publicly released via your account is your responsibility, however any misconduct in behavior from users of School Parents should be reported to a Site Administrator immediately.
Communication
From time to time, we may contact you via a notification in School Parents, which you may receive as an email, depending on your notification settings. You can subscribe to discussion forums to receive notifications when new posts have been made. We do not auto-subscribe you to community forums. If you’d like to receive notifications, you will need to subscribe yourself.
Updating our Terms
We may update these Terms from time to time. Your continued use of our Products will indicate your acceptance of the of the updated Terms.
Limitation of Liability
Our Products are provided "as is," and we make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). Our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or our Products. Our aggregate liability arising out of or relating to these Terms or our Products will not exceed the greater of $1 USD or the amount you have paid us in the past twelve months.
You agree to defend, indemnify and save us, our affiliated and subsidiary corporations, our officers, directors, employees, agents, successors, shareholders and assigns harm from and against all liability, loss, expense, fines, penalties, or damages (including legal costs) to the extent that such claim arises out of or is in any way connected with the non-performance or breach of any obligation imposed on you by this agreement or other general laws and obligations or by reason of and to the extent of your fraud, negligence or willful misconduct or that of or any of your agents or employees.
We make no representations and give no warranties, guarantees or undertakings concerning our provision or administration of School Parents, or your use thereof, except as expressly set out in this agreement. Other warranties, express or implied, by statute or otherwise (including but not limited to the warranties of merchantability, fitness for a particular purpose, and satisfactory quality) are excluded from this agreement. It is intended that this clause will apply only to the maximum extent permitted by law.
Governing Law
These Terms and Conditions are governed by the laws of the State of Missouri, without regard to conflicts of law provisions. Any arbitration, enforcement of an arbitration or litigation will be brought in Platte County, Missouri and you consent to the jurisdiction of the federal and state courses located in Platte County, Missouri and submit to the jurisdiction thereof and waive the right to change venue. You further consent to the exercise of personal jurisdiction by any such court with respect to any such proceeding.
Other
These Terms make up the entire agreement between you and Cyber Valley Agency LLC regarding your use of our Products. They supersede any prior agreements. If any of these Terms are found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment or waiver of these Terms must be made in writing and signed by us. We reserve all rights not expressly granted to you. We may use any feedback and other suggestions you provide to us without any restriction or obligation to compensate you. You may not transfer any of your rights or obligations under these Terms to anyone else without our consent. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
